The U.S. Patent and Trademark Office within the Department of Commerce is soliciting comments on the current state of artificial intelligence technologies and issues related to inventorship.
The USPTO is asking the public to submit written responses to a list of questions related to the use of AI and machine learning in the invention creation process and the patentability of an invention with contributions from an AI system, according to a Federal Register notice published Tuesday.
The agency also wants to know if there is a need to expand current guidance on inventorship to address scenarios in which AI contributes to a particular invention and seeks to determine additional measures it should take to further incentivize AI-enabled innovation and mitigate risks from such innovation.
The USPTO also plans to collaborate with academia through research initiatives and conduct a series of stakeholder engagement sessions regarding AI-enabled innovation and inventorship to help inform future efforts.
Responses to the questions and comments are due May 15.
